Agreement to Terms

By accessing or using the AuraPost platform (the "Service"), you agree to be bound by these Terms of Service and all policies incorporated by reference, including our Privacy Policy and Acceptable Use Policy. If you are entering into these Terms on behalf of a company or other legal entity, you represent that you have the authority to bind that entity. If you do not agree with these Terms, you must not use the Service. EWARDS ENGAGEMENT PRIVATE LIMITED reserves the right to update these Terms at any time; continued use of the Service after the effective date of a change constitutes your acceptance.

Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must provide accurate and complete information when registering and must keep that information current. You must not share your account with others, use automated scripts to create accounts, or attempt to access another user's account without authorisation. You must promptly notify us at support@theaurapost.com if you suspect any unauthorised use of or access to your account. AuraPost will not be liable for any loss arising from your failure to keep your credentials secure.

Acceptable Use

You may use the Service only for lawful purposes and in accordance with these Terms. Prohibited uses include: sending unsolicited commercial email (spam); transmitting malware, viruses, or malicious code; impersonating another person or entity or falsifying email headers; interfering with or disrupting the integrity or performance of the Service or its infrastructure; attempting to gain unauthorised access to any portion of the Service; using the Service to harvest email addresses or to conduct phishing attacks; and any use that violates applicable laws or regulations. We reserve the right to suspend or terminate access to any account that we believe, in our sole discretion, is engaged in prohibited activity without prior notice.

Anti-Spam

AuraPost operates a permission-based email platform and has a zero-tolerance policy for spam. You must comply with all applicable anti-spam laws, including the U.S. CAN-SPAM Act, the EU General Data Protection Regulation (GDPR) consent requirements, Canada's CASL, and any other laws applicable to recipients in the jurisdictions you are sending to. You are strictly prohibited from sending to purchased, rented, scraped, or otherwise acquired email lists; sending to addresses that have not given clear and verifiable consent to receive communications from you; suppressing or failing to honour unsubscribe requests; and failing to include a functional, clearly visible unsubscribe mechanism in every commercial message. All emails sent through the Service must include your legal postal address and must not use deceptive subject lines or sender information.

WhatsApp Messaging

If you connect a WhatsApp Business Account to the Service, you are solely responsible for obtaining valid recipient opt-in consent before sending any WhatsApp message, for honouring opt-out requests, and for complying with Meta's WhatsApp Business Messaging Policy and Commerce Policy as in effect from time to time, in addition to these Terms. You must connect and use your own WhatsApp Business Account and phone number — AuraPost does not provide a shared WhatsApp number. All message templates sent through the Service are subject to Meta's own template-approval process and may be rejected, paused, or revoked by Meta at its sole discretion, for reasons outside our control. You must not use the Service to send WhatsApp messages containing content prohibited by Meta's policies, including promotional content sent outside an open customer-service session without an approved template. We may suspend your WhatsApp messaging access, independently of your email sending access, if your WhatsApp Business Account's quality rating degrades, if Meta suspends or restricts your account or ours, or if we reasonably believe your use violates Meta's policies or these Terms.

Push Notifications

If you install AuraPost's push notification script on your website, you are solely responsible for how visitors are prompted to subscribe and for complying with applicable consent and electronic-marketing laws in the jurisdictions your visitors are located in. You must not use deceptive prompts to obtain notification permission, and push content is subject to the same Acceptable Use restrictions as any other channel. Push subscriptions are anonymous by default and are only linked to a visitor's identity if you choose to call our identify function — you are responsible for having a lawful basis to do so and for honouring any request to unsubscribe or to have that link deleted. Delivery of a push notification depends on your visitor's browser and its vendor's own push service remaining reachable, which is outside our control; we do not guarantee that any specific push notification will be delivered, displayed, or clicked. We may suspend your push messaging access, independently of your email or WhatsApp sending access, if we reasonably believe your use violates this section or these Terms.

Sending Limits & Suspension

To protect the shared sending reputation of all customers and to comply with our upstream provider's policies, AuraPost monitors bounce rates, spam complaint rates, and other deliverability signals in real time. Accounts that exceed a hard-bounce rate above 5% or a spam complaint rate above 0.1% of sends within any rolling 24-hour window may be automatically paused without prior notice until our compliance team has reviewed the situation. You are responsible for maintaining clean, engaged lists and for promptly removing bounced and unsubscribed addresses. Repeated violations may result in permanent account termination and forfeiture of unused account credits.

Billing

AuraPost operates on a prepaid wallet or credit model: you purchase sending credits in advance, and they are drawn down as email, WhatsApp, and push messages are sent. All charges are in the currency displayed at the time of purchase and are exclusive of applicable taxes, which you are responsible for paying. Credits are non-refundable except where required by law or as expressly stated in our refund policy, which is available on request from support@theaurapost.com. If your wallet balance reaches zero, outgoing sends will be paused until you top up. Pricing may change with reasonable prior notice posted to this page and communicated by email.

Intellectual Property

EWARDS ENGAGEMENT PRIVATE LIMITED retains all right, title, and interest in and to the Service, including all software, interfaces, documentation, and underlying technology. Nothing in these Terms transfers any intellectual property rights to you. You retain ownership of the content and data you upload or generate through the Service; by submitting content you grant us a limited, non-exclusive licence to process and transmit it solely as necessary to provide the Service. You must not copy, modify, distribute, reverse-engineer, or create derivative works from any part of the Service without our prior written consent.

Termination

You may close your account at any time through your account settings or by contacting support@theaurapost.com. We may suspend or terminate your access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms, engage in prohibited activity, or if we are required to do so by law. Upon termination, your right to use the Service ceases immediately, and we may delete your account data in accordance with our data-retention policy. Provisions of these Terms that by their nature should survive termination (including intellectual property, limitation of liability, and governing law) will survive.

Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. EWARDS ENGAGEMENT PRIVATE LIMITED does not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components, or that any specific email sent through the Service will be delivered, opened, or acted upon by the recipient. You use the Service at your sole risk.

Limitation of Liability

To the maximum extent permitted by applicable law, EWARDS ENGAGEMENT PRIVATE LIMITED, its directors, employees, agents, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, goodwill, or business opportunity — arising from your use of or inability to use the Service, even if we have been advised of the possibility of such damages. Our total cumulative liability to you for all claims arising out of or relating to these Terms or the Service shall not exceed the greater of the amount you paid us in the three calendar months preceding the claim or one hundred US dollars (USD $100). Some jurisdictions do not allow the exclusion or limitation of certain types of liability, so some of the above limitations may not apply to you.

Changes to These Terms

We may revise these Terms from time to time. When we make material changes, we will update the effective date at the top of this page and provide notice via email or in-app notification at least 14 days before the changes take effect for existing accounts. Your continued use of the Service after the revised Terms become effective constitutes your binding acceptance of those changes. If you do not agree with a revised version of the Terms, you must stop using the Service before the effective date.

Governing Law

These Terms and any dispute arising out of or related to them or the Service shall be governed by and construed in accordance with the laws of West Bengal, without regard to its conflict-of-law principles. You agree to submit to the exclusive jurisdiction of the courts located in West Bengal for the resolution of any such disputes, and you waive any objection to the laying of venue in those courts. Nothing in this section limits our right to seek injunctive or other equitable relief in any jurisdiction to protect our intellectual property or confidential information.
